The U.S. Environmental Protection Agency (EPA) has added nine additional per- and polyfluoroalkyl substances (PFAS) to the Toxics Release Inventory (TRI), bringing the total number of PFAS subject to TRI reporting to 205. This update is part of the EPA’s ongoing efforts to enhance transparency and public access to information about toxic chemical releases.
These additions were made under the Fiscal Year 2020 National Defense Authorization Act (NDAA), which mandates the automatic inclusion of PFAS in the TRI when the EPA finalizes toxicity values or when confidentiality claims are lifted. One of the newly added PFAS had previously been excluded due to a confidential business information (CBI) claim, which has since been removed.
Facilities that manufacture, process, or use these chemicals above threshold levels must begin tracking their activities as of January 1, 2025, with reporting forms due by July 1, 2026. These PFAS are also now classified as chemicals of special concern, eliminating exemptions for small concentration use and reinforcing the EPA’s commitment to environmental justice and public health.
